(a)जी व्यक्ती, राष्ट्रपती म्हणून पद धारण करीत असेल अथवा जिने असे पद धारण केलेले आहे ती व्यक्ती, संविधानाच्या अन्य तरतुदींना अधीन राहून त्या पदासाठी होणाऱ्या फेरनिवडणुकीस पात्र असेल.
(b)कोणतीही व्यक्ती राज्य सभेचा सदस्य म्हणून निवडून येण्यास अर्हता प्राप्त असल्याखेरीज राष्ट्रपती पदाच्या निवडणुकीस पात्र असणार नाही.
